Nukes, Dow Chemical, Rockwell International, Teflon, DuPont, Regulations, and the Trump Crew - REDUX

I posted the piece at the link below about four years ago.  It's still relevant today, and demonstrates why regulations, inspections, and enforcement are all crucial to our health and safety.  Plus, it shows (again) why Trump is an utter disaster.  [It boggles the mind that anyone still supports him.]

Nukes, Dow Chemical, Rockwell International, Teflon, DuPont, Regulations, and the Trump Crew

Preface---
As a reminder, one of my few areas of expertise is environmental regulatory compliance (expertise both academic & "in the field") and HazMat & HazWaste inspections of relevant facilities.  Years ago, I worked for both public and private institutions in these areas.  The essay below will illustrate why the Trump Administration's gutting of environmental and health & safety agencies and their regulations ultimately will prove to be disastrous.

For almost two decades just prior to 1975, Dow Chemical---a private contractor---operated the Atomic Energy Commission's Rocky Flats bomb factory in Colorado.  Because of Dow's improper storage of thousands of drums of oil contaminated with plutonium, those drums corroded and leaked plutonium into the soil, water, and air.  Dow also "disposed" of contaminated water by spraying it on fields surrounding the facility...claiming that was "irrigation".  A Whistleblower by the name of James Stone brought this all to light, and of course, he was fired or forced to resign.  In 1975, a new Gov't Department took over and a different contractor was hired.

Throughout the 1980's and culminating (in 1989) in an FBI raid on the Department of Energy (DOE) Rocky Flats nuclear bomb manufacturing facility, Rockwell International (the other private contractor) was illegally disposing of hazardous waste contaminated with plutonium.  Plutonium has a half-life of 24,000 years and is considered by many to be the most toxic substance on Earth.

The illegal disposal resulted in plutonium contaminating not only soil, but the air, the groundwater, and surface streams as well.  Over 60 pounds of the toxic substance were found to have accumulated in the ductworks of just one building of the plant.  The US EPA and the Colorado Dept. of Health both were prohibited by DOE from inspecting the key areas of the entire facility.  "National Security".  Meanwhile, plutonium was contaminating the air, soil, and streams that wound up in drinking water reservoirs.  Eventually, DOE succumbed to pressure and submitted a huge Report detailing the hazardous waste and what was done with it.  The FBI studied all 27 volumes of the Report, and even took water samples just offsite of Rocky Flats.  That all led to the raid on the facility...one Agency raiding another.

Decades and decades ago, DuPont Chemical introduced teflon, the non-stick coating for cookware.  The chemicals in teflon also became incorporated into many other consumer items, such as water resistant fabric, stain resistant carpet, dental floss, microwave popcorn bags, fast food wrappers, and others.  DuPont kept a crucial secret from consumers regarding those chemical ingredients:  they are highly toxic, and eventually became linked to six different diseases, including kidney cancer.  For years, DuPont discharged wastes containing those chemicals into the waterways adjacent to their manufacturing facilities in Parkersburg, West Virginia.

People began to notice health problems in the area such as cancer and liver disease.  There was a question, too, of birth defects.  Plus, over 150 cattle died of some strange, blood hemorrhaging condition.  Suspicions were high that DuPont manufacturing activities might be linked to those health problems.  Some residents of Parkersburg, former DuPont employees, a cattle farmer, and lawyers launched what turned out to be a 17-year effort to find out the truth of the matter.  The attorney, Rob Bilott, was especially instrumental in bringing a class action lawsuit against DuPont.

In addition to discharging waste into waterways, DuPont buried seven thousand tons of contaminated waste in a nearby landfill.  Later, it was discovered that the teflon chemicals were in the drinking water of the region.

It's estimated that 99% of Americans have these chemicals in our bodies, and most of the population of the rest of the world as well.  That's because the waste also was discharged to the air until 2013; DuPont finally stopped manufacturing the substances during that year.

The point of all the above is that EHS (environmental/health/safety) matters are considered "externalities" by most mega corporations.  In other words, those matters don't count; generally, big companies don't give a damn about them.  Yes, they TALK a great game, and a very few may even actually be sincere, but generally the reality is much different.  The Big Boys mostly have to be forced to care...or at least act as if they do.  That's done by regulations, and enforcement of those regs.  Without that, we'll have even more pollution, disease, birth defects, poisoning, and negative impact on 99% of our population.  That's precisely what Trump & Crew are promulgating with their gutting of EHS agencies and regulations.

Comey's Testimony - Wow!

As to Comey's testimony---
1.  Regarding who's lying, Trump or Comey, The Don is the loser...Trump is lying...it's not even close.
2.  McCain sounded like a befuddled old man:
more than once, he referred to Pres. Trump as Pres. Comey; and more importantly, he couldn't seem to keep the difference between two investigations straight.  His questions were just bizarre.
3.  I'm not a fan of Comey's (or for that matter, some of what the FBI does---such as sometimes writing their own Search Warrants), but I'll say this:  after watching all 2+ hrs of his testimony, I'm convinced that in that particular matter he was professional, truthful, totally open, and did a bang-up job.  Compared to Comey, Trump has proven himself to be unprofessional, ignorant, clownish, & an unrepentant liar.  Why he's still in office is beyond my comprehension.

The Repubs most likely won't vote for Impeachment (although that's not guaranteed...I imagine many would rather see Pence as Pres.), but I still predict that Trump will be out before the end of his 1st 4 yrs.  The probability of that is very high.

The Emperor is not Wearing any Clothes


By "The Emperor", I'm referring not only to our President, but also to the U.S. Treasury, the Fed Reserve, the Justice Department in general, the NSA, The FBI, the SEC, the CIA, and the Pentagon.  Without too much effort, I also could include the U.S. Congress and the U.S. Supreme Court.  At the highest levels, most of our Fed Gov't consists of people engaged in obvious deceit and outright fraud.  On top of that, many of their activities are utterly and blatantly unconstitutional.

For examples of the deceit, fraud, and unconstitutionality, I could refer you to the past posts on this venue... for over seven years now.  That, however, really isn't necessary.  Anyone who has made a sincere effort to stay abreast of the political and economic news (not just from the Corporate Media) in the past few decades knows what's happening.  Despite that, let's at least cite a very few of those examples.

1.  Read Article II of the U.S. Constitution.  It's the section that enumerates the powers delegated to the Executive Branch by We the People.  Nowhere in Article II is the President delegated the power to put this Nation at war.  War-making powers reside with the U.S. Congress.  Despite the Orwellian view of Obama (and just about all past Presidents since the end of WW II), the "Commander-in-Chief" is not Constitutionally permitted to commit the military to war...by himself.  Those at the highest levels in our Gov't surely cannot help but know that for a fact.  That means they all are violating their Oath to preserve, protect, and defend the Supreme Law of the Land.

2.  Neither does Article II delegate power to the President to write "Executive Orders" on any subject he pleases.  Only two subjects are enumerated:  a written report from any of the Executive Department Heads on any topic relevant to their Departments; and, the power to issue Presidential Pardons (except in the case of Impeachment).  Today's puppets of the Oligarchy claim that Article II implies that other Executive Orders may be written as well.  That belief has prevailed for decades and decades.  In the beginning, back in the 1800s, the Orders were innocuous---things such as declaring a certain day to be in honor of the Mighty Oak Tree, or some such trivia.  But for years now, the fraudulent power has been used to bypass Congress.  It has made the modest Office of the President into that of a soft dictator.  Let's be clear:  the Constitution does not imply powers; instead, it enumerates them.  Republicans & Democrats at the highest levels know that full well; they simply don't want to give up the usurped power.

3.  The FBI now can search your home without a proper warrant.  The Agent simply writes what's known as a "National Security Letter"; that supposedly serves as a search warrant.  If you're not home, they don't have to inform you that your house was searched.  Not only that, if you are home and aware of the search, the Agent can tell you to never reveal the fact of the search to anyone...under penalty of being sent to prison.  This is what's known as a Police State.  [The late writers George Orwell (1984) and Aldous Huxley (Brave New World) must be amazed that their fictional dystopias have more or less materialized.]

4.  The U.S. Treasury - Fed Reserve System - Banking monetary system is a complete fraud and scam.  There's so much legitimate info on that subject so as to make it unnecessary to explain it further.  Nevertheless, consider the following quotes.

"I am afraid the ordinary citizen will not like to be told that the banks can and do create money. And they who control the credit of the nation direct the policy of Governments and hold in the hollow of their hand the destiny of the people." Reginald McKenna, as Chairman of the Midland Bank, addressing stockholders in 1924.

"I believe that banking institutions are more dangerous to our liberties than standing armies." Thomas Jefferson, US President 

"If the American people ever allow private banks to control issue of their currency, first by inflation, then by deflation, the banks and the corporations will grow up around them, will deprive the people of all property until their children wake up homeless on the continent their fathers conquered. The issuing power should be taken from the banks and restored to the people, to whom it properly belongs." Thomas Jefferson in the debate over The Re-charter of the Bank Bill

According to the Constitution, Congress is charged with regulating the value of our money.  Congress does no such thing.  Plus, according to Alan Greenspan on a PBS News Hour interview several years ago, "No one has authority over us [the Fed Reserve]."  So, private banks both issue money (through the fraud of "Fractional Reserve Banking") and regulate the value of it...by the arbitrary interest rates set by the Fed.  The Fed is simply the Middle Man between the U.S. Treasury, other banks, and the People.  The private stockholders of the Fed make 6% interest (by Law) on all those Middle Man transactions.  Six percent doesn't sound like much, until you consider that billions of dollars are involved in those Middle Man transactions.  All of that is unnecessary...and nothing but a scam.

I suspect that many or most Americans feel that little or nothing can be done about everything written above...so about 50% of us "vote", thinking that we just need the "right" people in office.  History shows anyone who looks carefully that "voting" is not the answer, at least, not presently.  We've had well over 200 years of "voting"...things only have gotten worse.  Whether we care to admit it or not, Oligarchies control politics with propaganda, ballot-access laws, and money.  Neither is violent revolution the answer...for reasons that should be obvious.

An activist once said, "We be many; they be few."... it was a call to peaceful resistance.  The first step is to stop drinking the Propaganda Kool Aid.  Next, people need to identify what they want...what type of governance?  That's a most difficult question.  A republic protects individual rights, but throughout History, republics have been controlled by Oligarchies...the Meritocracy.  The overall results rarely have been good.  A pure, participatory democracy can be little more than mob rule...unless individual rights are protected regardless of what the "majority" wants.  So, it's a conundrum, a genuine dilemma.  There are other choices.  [Obviously, totalitarianism is not even up for consideration.]  One thing should be clear, though:  what we have now in the USA is not for the benefit of We the People.

The Deceivers Bush & Obama, and an American Patriot, Tom Drake

The primary source for this essay is the current piece on PBS Frontline titled, "The United States of Secrets".  It's the best, most detailed rendition that I've seen of how-why-where-when the Fed Gov't launched (via the NSA) its unconstitutional (& thus illegal), warrantless program of mass surveillance of Americans.  It also includes many interview clips with several people formerly in the Gov't who attempted to expose what the NSA called "The Program".  They tried first through proper Gov't channels, and when they were ignored, one of them became a whistleblower.  That was Tom Drake.

Mr. Drake was a dedicated NSA senior executive.  So was Mr. Edward Loomis... and there were some others... William Binney, J. Kirk Wiebe, etc.  They were appalled at what the Fed Gov't was undertaking.  Before getting into that, though, let's back up a bit.

The Program was conceived immediately after 9-11.  Michael Hayden, the Head of the NSA, was told by Bush-Cheney to come up with a Program to prevent another 9-11 attack.  Essentially he also was told to include tools that currently were not allowed by the Constitution or various Statutes.  He set to work doing exactly that.  It turns out that there was a program in existence prior to 9-11 that could monitor just about anyone..."ThinThread".  It had automatic, electronic"privacy protections" for American citizens.  The NSA stripped out those protections, thus ensuring that when The Program eventually was used, it violated the Fourth Amendment.  The justification by various Executive Branch, political appointee, puppet lawyers for its use was the Article 2 (of the Constitution) phrase, "Commander-in-Chief".  [Luckily, not being an attorney, I have some common sense and realize that the phrase cited does not negate other parts of the Constitution.  I think most non-puppet people know the same thing.]  By the summer of 2002, The Program was in full swing... doing something that never before had been allowed--- surveilling (without a proper warrant) American citizens, our phone calls, emails, financial transactions, credit card use, etc.  Literally TRILLIONS of individual bits of data.

Drake and the others were kept out of the secret loop at the NSA regarding The Program, but eventually it was leaked to them that their ThinThread Program had been altered and was being used in an illegal manner.  In addition, the major phone companies in the USA were turning over customer phone call records to the NSA.  Apparently, these words from the Fourth Amendment are not understood by the Executive Branch:  "The right of the people to be secure in their persons, houses, PAPERS, and EFFECTS..." (emphasis added).  [In actual fact, I believe those words are understood by the Feds; they had/have another agenda--- expansion of Power in the U.S. World Domination Game, what Brzezinski once called "American Primacy and its Geostrategic Imperatives".  From their perspective, 9-11 was a fortuitous excuse to run amok.]

Bill Binney, getting nowhere in the NSA with his concerns met with Diane Ruark, a top Congressional Staffer with 17 years of experience in the Intelligence field.  A "Conservative" Republican, Ruark nonetheless was extremely concerned that the NSA had "gone rogue".  She launched a campaign to inform Congress.  Of course, by then it was too late--- the White House already had brought Congress on board.  Oversight of the NSA was basically dead.  Porter Goss was Ruark's boss; he sent her to Michael Hayden, NSA Head.  He basically evaded her questions, but in a politically incorrect manner, she persisted.  Finally he essentially told her to mind her own business because he had authority for The Program from the highest level (the "Commander-in-Chief").  Keep in mind that she was on the Congressional Committee for Intelligence OVERSIGHT.  Checks and Balances in our Gov't, for all intents and purposes, were gone.

A few attorneys in the Executive Branch opposed The Program due to its unconstitutionality.  They basically were thrown under the bus, so to speak.  The Program grew, despite the fact that the Justice Dept. determined part of it to be illegal.  Because I don't have the time for all the essential details, I highly recommend that people watch the Frontline piece.  It is a feature-length film, but fascinating and well worth the watch.

Eventually, some knowledge of The Program reached the public.  Bush and Hayden were pretty much forced to say something publicly.  Both were deceitful; only a tiny part of the operation was justified... the part dealing with specific terrorist suspects.  The public was propagandized.  Bush eventually lied about warrantless surveillance of innocent Americans by an agency forbidden to spy on Americans.  A couple of dissidents in the Gov't attempted to get the story published in the New York Times.  Despite what the Right Wing in the USA thinks, the Times often kow-tows to the Feds.  They did.

A year later, a reporter essentially forced (see the film) the Times to reconsider.  Bush and Hayden tried to intervene; they were unsuccessful.  The story was published in December, 2005.  It "shocked the world", according to one commentator.  Bush again went public and again was deceitful about The Program; nothing was said about monitoring trillions of emails, phone calls, etc.  Hayden lied, saying, "Not a single employee of the NSA has expressed any concerns about...blah-blah-blah.".  [Hayden is known as a masterful propagandist... evasive, deceitful, and totally loyal to the Institution.]

Enter Tom Drake.  After four years of exhausting all in-house means of expressing concern, he contacted The Baltimore Sun and blew the whistle...anonymously.  All the documents he used were UNCLASSIFIED.  USA Today published another leak from a different whistleblower.  The Times came out with another story.  Cheney went crazy, that is, crazier than his usual.  He was determined to stop the leakers (of unclassified info).   A massive manhunt was launched by the FBI and it was led by Alberto Gonzales, former White House Counsel and then currently the Attorney General.  Long story short, the FBI raided the homes of several people (Binney, Wiebe, Ruark, Loomis, etc., pretty much destroying their careers), but found nothing.  They finally, six months later, got around to the home of Tom Drake.  They seized a trove of UNCLASSIFIED documents, and he was charged under the Espionage Act.  He faced possibly life in prison... for exposing Gov't unlawfulness.  The seized documents were altered... "unclassified" was crossed out and they were marked "secret".

As the investigation proceeded, the Govt's cases began to fall apart.  In 2008, enter Barack Obama.  "No more secrecy!"  Another quote: "The most transparent government [what his Administration, if elected, will be]".  "Whistleblowers are good for government; they will be protected by my Administration [if elected]." "No more illegal wiretapping of American citizens [if elected]."  Obama becomes President.  He continues The Program.  Prior to that, though, Bush reverses himself and decides he needs Congress to make The Program permanent.  His Administration pushes through an Amendment to the FISA law.  He claims it's "reform", but Intelligence insiders know that it gives the NSA unprecedented powers.  The Program is expanded, made worse from the standpoint of the Constitution.  The Amendment Bill had to be read extremely closely in order to figure out exactly what it said.  Insiders expressed the opinion that Congress had little clue as to what the Bill really said.  [Even if they had understood it, politicians seem to count on Americans being unaware of the fact that no law supercedes the U.S. Constitution.  The Fourth Amendment cannot be negated by any Act of Congress.]

Senator Obama supported the Amendment.  So even before he was elected President, the public should have had a clue that he was, at the very least, insincere in his campaign rhetoric concerning wiretapping (with no probable cause) of Americans.  At most, he was lying.

President Obama's Administration continued the case against Tom Drake.  So much for protection of whistleblowers.  Drake's career was over, his finances were decimated (because of legal defense expense), his life more or less trashed.  To get the whole thing over with, he pled guilty to a misdemeanor (they never had any espionage case) and received a minor fine and community service.

The Program continues to this day... a clear violation of the Fourth Amendment, and "justified" by a law.  In the bizarro world of DC, apparently laws do supercede the Supreme Law of the Land.  Amazing.

Who cares?  Why is any of this important to Americans, especially non-political Americans.  Here's one reason why:  the whole scenario is Soft Fascism.  It violates our Constitution and our Rights.  It has been implemented by both major political parties, and there's little reason to believe that more of our Rights won't be trashed down the line somewhere.  As Lord Acton said long ago, "Power corrupts, and...".

Finally, our Gov't is doing this worldwide.  Particular Snowden documents have revealed that the NSA is even spying on the economic meetings of our allies.  That has nothing at all to do with terrorism.  We're losing any reputation we ever had as a great nation.  Worse, our Govt's NeoImperialistic methods are making enemies of people who once admired our country.  In their attempts to dominate the world, our Gov't is over-reaching... not only making enemies, but bankrupting us in the process.

I hope many of you watch the Frontline piece.  The content should inform and disturb you.  In any case, I salute Tom Drake and the other people in the film who tried, at great personal cost, to wake up both Congress and the public to our Govt's grossly unlawful activities.  Kudos to you all.  The same praise goes to Edward Snowden.  His story is in Part Two of the film.

Addendum to: Signs That the Elites in Our Gov't Have Lost It

As reported on Democracy Now! ---

1.  The FBI has deemed Ryan Shapiro's PhD Dissertation on Animal Rights to be a threat to national security.  Ryan, an Animal Rights activist, is a PhD candidate at M.I.T.  He also has submitted more Freedom of Information Act (FOIA) requests to the Feds than any other American.  Perhaps the tagging of his Dissertation was Gov't payback for all those FOIA requests...who knows.

2.  In 2006, Dubya Bush signed into law the Animal Enterprise Terrorism Act (AETA).  As a result, animal rights activists who go undercover into Big Ag factory farms and film deplorable conditions and gross mistreatment of livestock may be charged with terrorism.  Nonviolent, peaceful activists who stage sit-ins or lie-downs at such factory farms are not just practicing civil disobedience protests anymore; they may be charged with terrorism as well.

3.   The Feds have tagged the underground Animal Rights activists (not the out-in-the-open protesters) and the underground environmental protesters as the number one domestic terrorist threat.  So, if you break into, say, a fur farm at night and release all the critters, you're part of the number one terrorist threat in America.  Really?  Imagine if you stole an apple in the process.  Admittedly, a few of these eco-activists and animal rights activists who are clandestine have burned structures to the ground or otherwise damaged the property of Big Business in the past...but, the number one domestic terrorist threat?  I don't think so.  As far as I know, not one person has been injured as a result of their illegal actions.

4.  In the course of monitoring the peaceful "Occupy Houston" protest not too long ago, the FBI discovered a sniper plot against the leaders of that rally.  The FBI kept that fact from everyone.

5.  In a memo and a scenario similar to a portion of the old COINTELPRO, the FBI describes how peaceful Animal Rights activists can be neutralized by spreading false rumors that certain ones of them are FBI undercover agents.  More lies from the Fed Gov't.

6.  Ryan Shapiro (see number 1. above) is suing the NSA, FBI, and DIA (Defense Intelligence Agency) for their refusal to disclose the USA role in the imprisonment of Nelson Mandela.  Shapiro also wants to know why the Gov't kept Mandela on the Terrorist Watch List until 2008... which is another indication of how the management of all this unwieldly "terrorism" info is really beyond the capability of the sprawling Fed Gov't.  The right hand often doesn't know what the left hand is doing.  I think there's a misconception amongst the public that the central government is one big monolith.  In reality, it's thousands of semi-autonomous institutions which often are competing for turf and funding.  The result is what you see today...some of it good, much of it miserably bad.

The Lodi Case: Overly Zealous, Unprofessional FBI

I urge people to watch at least Parts 5, 6, & 7 of this revealing piece (each segment is less than 10 minutes long). Actual interrogation tapes of the suspects are shown, demonstrating the desperation of the FBI to make a case after having paid an informant about $250,000 dollars.

These are examples of how NOT to conduct an interrogation. I say that because I personally knew Professor Fred Inbau, the man most responsible for developing techniques for modern criminal interrogations...and because the ex-FBI consultant in the piece confirms my belief.

This is pretty scary---it demonstrates with painful clarity what can happen when the Fed Govt thinks you're guilty, and you don't exercise your right to an attorney before questioning. As the ex-FBI consultant stated, "It's shameful.".
